Stier seeks insight into FDA decisionmaking

Jeff Stier, senior fellow at the National Center for Public Policy Research, has filed a request with the U.S. Food and Drug Administration under the Freedom of Information Act, to gain insight into how the agency weighed the cost and benefits in establishing its final rule.

Stier is asking for all correspondence, documents, meeting minutes and transcripts from the FDA to the Office of Management and Budget relating to the final rule.

In filing his request, Stier asked the FDA for expedited processing, citing ‘danger to human life.’

“People who quit smoking with e-cigarettes that were not on the market prior to the predicate date have told me they’ll go back to smoking combustible cigarettes if the rule is enforced as is,” Stier explained.
