Final rule’s August 8 deadline close

The US Food and Drug Administration’s ‘final rule’ that extends its regulatory authority to certain ‘tobacco’ products for which it was previously not responsible, goes into effect on August 8.

From that date, the agency will extend its reach to take in products such as electronic cigarettes, cigars, hookah and pipe tobacco, certain dissolvables, and nicotine gels.

‘Some of the rule’s provisions that apply to retailers and manufacturers will take effect immediately on August 8, and others will take effect later,’ the FDA said.

‘To help make the process of complying as smooth as possible, CTP [Center for Tobacco products] will continue to provide information along the way.  ‘Some information is particularly important for retailers, manufacturers, importers, and distributors to know early on. For example, several provisions take effect on August 8 that restrict the sale of newly-regulated tobacco products to youth.

‘Other provisions taking effect on or around that date relate to “modified risk tobacco products,” user fees associated with cigars and pipe tobacco, and the marketing of certain new products.
