    MVCC Desires Regulatory Certainty for Vape Industry  

    The Malaysian Vape Chamber of Commerce (MVCC) called on the government to maintain regulatory certainty for the vape industry following its decision not to pursue an appeal concerning the legal status of nicotine in vape products. MVCC Secretary-General Ridhwan Rosli said the Control of Smoking Products for Public Health Act 2024 (Act 852) was developed through an extensive legislative process involving government agencies and industry stakeholders and should continue to serve as the basis for regulating vape and other smoking products. He stressed that the industry had supported regulation and made significant investments to comply with requirements covering products, packaging, labelling, registration, and business operations.  

    MVCC warned that changes to the legal position could create uncertainty for businesses that have made investment and operational decisions based on Act 852. The chamber said it does not oppose regulation or measures addressing public health, product misuse, or enforcement concerns, but believes these issues should be tackled through stronger enforcement or targeted amendments rather than undermining the existing framework. MVCC is urging the government to ensure consistent implementation of Act 852 while balancing public-health objectives with the sustainability of businesses, employees, distributors, and retailers across the vape industry.

    South Korea to Regulate Vapes as Cigarettes from April 24

    South Korea will begin regulating liquid e-cigarettes under the same framework as conventional cigarettes starting April 24, following revisions to the Tobacco Business Act. The updated law expands the definition of tobacco products to include all nicotine-based products, bringing vapes under rules covering health warnings, advertising restrictions, and retail licensing requirements.

    The changes also extend smoking bans to vaping, prohibiting use in designated non-smoking areas, and introduce tighter controls on automated sales devices amid concerns over youth access. Authorities said enforcement checks will begin immediately, as vape use continues to rise despite declining conventional cigarette smoking rates.

    Western Australia Tightening Tobacco and Vape Laws

    The Government of Western Australia Department of Health updated its website to address the new legislation that it is preparing to implement to strengthen tobacco and vaping controls, targeting the growing illicit market with tougher enforcement measures. The laws make it an offence to sell, supply, or possess illegal tobacco or vape products, grant authorities powers to shut down non-compliant premises, and introduce significantly higher penalties. Public smoke-free areas will also be extended to include vaping.

    The government said further reforms are planned for later in 2026, including stricter rules for landlords and licensing, as part of a broader effort to curb illegal trade and enhance public health protections.
