    Driscoll Named Interim Head of ATF

    Yesterday (April 9), Dan Driscoll was named interim head of the Bureau of Alcohol, Tobacco and Firearms by the Trump administration, replacing new FBI director Kash Patel. Driscoll is expected to simultaneously run the ATF and continue with his current role as Secretary of the Army. This will be the first time the embattled agency has been placed under the Defense Department.

    According to The Guardian, Trump’s aides view the ATF and its mission with skepticism and have discussed gutting the ATF or merging it with the Drug Enforcement Administration, “another small and underfunded agency that has previously been part of the Justice Department.”

    “Patel has been running the FBI and the ATF for months, but it had proved to be overly burdensome, and Driscoll was selected to replace Patel as the interim head, as he was one of the few Senate-confirmed appointees available,” The Guardian wrote. “The decision to have the army secretary run the ATF could be the precursor to such a move or at least to dramatically reduce its size and scope. In recent weeks, ATF agents have been diverted to help with enforcing Trump’s immigration agenda.”

    Former Tory Contender to Work for BAT

    The Guardian reported today (April 10) that Penny Mordaunt, the former U.K. Conservative leadership contender who served in cabinet roles from defense secretary to leader of the House of Commons, has taken a job advising British American Tobacco’s (BAT) “transformation advisory group” on harm-reduction.

    Mordaunt’s new job was revealed by the Advisory Committee on Business Appointments, which said she should not lobby the government for two years after leaving office or advise on any public contracts.

    In its analysis, the committee said, “British American Tobacco has a significant interest in government policy and regulation and has resources focused on influencing government decisions – for example lobbying for a reduction in taxes for cigarettes, legislation on vaping and the prevention of counterfeit goods.”

    The committee said there were only limited risks associated with Mordaunt’s access to information that could help BAT given the change of government and the amount of time that had passed.

    However, it added: “Whilst you said you will not lobby, there is a risk your former role as a cabinet minister will be seen to offer British American Tobacco unfair access to and influence within government. Therefore, the committee’s advice is that you should have no direct engagement with government on behalf of the company, as to do so would raise significant risks under the government’s rules.”

    When asked about Mordaunt’s role, BAT chief corporate officer Kingsley Wheaton said, “BAT has launched a manifesto for change … it is founded on the very best tobacco harm reduction [THR] thinking and science. To accelerate that ambition, we understand alternative viewpoints that challenge our thinking will maximize success. This THR advisory board is designed to do just that.”

    FDA Whistleblower Dishes on Agency’s Shortfalls

    David Oliveira, who recently left the FDA after six years as a senior staffer, is speaking out about problems at the agency under the Biden administration, including tobacco control, diversity, equity and inclusion, and failures to combat China flooding the U.S. market with illicit vapes after the FDA’s top tobacco official was removed from his position. 

    “Many of us had been anticipating it for quite some time. We knew that change was drastically needed at FDA when it came to Tobacco Control,” Oliveira said in an interview with Fox News Digital. “Because Tobacco Control had really gotten out of control, there were many, many failures in core missions for the center that needed dramatic change and new leadership.

    “Many of us, whether it be from public health, consumers, small business owners, industry, and including even Senator Dick Durbin, who last year at a hearing said to Brian King, ‘It looks to me that you have fallen down on the job.’ So really, it runs the spectrum of people who are unhappy with what’s gone on recently with FDA in terms of tobacco regulation.

    “I frequently would attend shows and visit vape shops, and I was somewhat a canary in a coalmine, and would report back as to what I was seeing, and I would warn them that what I was seeing on the ground was out of control. We had a lot of people in the building who would go online and try to do some surveillance, but when you get out into the real world and you see the number of vape shops that are flooded with these illicit products, and I started to warn them about the amount of nicotine that was in these devices. We went from a Juul device, which had around 200 puffs, which was the equivalent of one pack of cigarettes, then I started seeing 5,000 puffs. I brought that warning back to the center, and then the following year would see 10,000 puffs. Now on the market, you can see 40,000 and 50,000 puffs. This is what the Chinese have done. They have not sought to get products authorized. They will introduce the latest and greatest technology. I saw a Santa one that was red and white. They’ll introduce flavors like Gummy Bear, Blow Pop, and Fruit Rollups, and these things that are absolutely youth-appealing because they do not care.”

    Indiana Bill Allows Vendors to Sell Cigars at Events

    A bill would allow tobacco vendors in Indiana to obtain a three-year supplemental cigar sales certificate, allowing them to sell cigars at an event on a temporary basis, passed through the Senate today (April 9) by a vote of 41-8. House Bill 1468, authored by State Rep. Kyle Miller, will head to the governor’s desk following a concurrence vote in the House.

     “I am thrilled to see my legislation pass through the Senate,” Miller said. “HB 1468 will help many small businesses that sell cigars across our state by allowing them to vend at public events. This legislation will ensure that our businesses are engaging with their communities and can promote their trade outside of their shops. 

    “Passing this bill is a great step taken by the legislature to foster entrepreneurship in Indiana by promoting our small businesses. As a small business owner myself, I’m proud to fight for legislation that encourages entrepreneurship in our state.”
